Terms of service for DonorEye
These terms apply when your organisation uses DonorEye (donoreye.com). The service is for organisations and businesses, not for consumers. You can try it free for 30 days before the first payment.
1. Who we are
DonorEye is provided by Klarlinje ASP, a Norwegian sole proprietorship, organisation number 936 712 940 (VAT registered: NO 936 712 940 MVA), Møllergata 6, 0179 Oslo, Norge. Questions about these terms: hello@donoreye.com.
"We" means Klarlinje ASP. "You" and "the customer" mean the organisation that uses the service, and the person who accepts these terms on its behalf.
2. What the service is
DonorEye gives feedback on fundraising letters and other direct mail before they are sent: an assessment with a score, a review of how a skimmer probably reads the letter, suggested changes, new variants of the text, a PDF report and a short video. The assessments are made by AI models and by figures counted in code (for example the red pen test and the LIX readability index).
3. The feedback is an aid
- Assessments, suggestions and variants are advice, not a final answer. You decide what is sent, and you are responsible for what you send.
- AI can be wrong or make up wording. Check facts, figures and names before you use a suggestion.
- "Expected gaze" and the skimmer video are based on known gaze patterns and on the path the AI laid out for the letter. It is not measured eye tracking.
- Checklists about rules in Norway, Germany, Spain and other countries are guidance, not legal advice.
- We do not promise that a letter you change after our advice will bring more or larger gifts.
4. Account and access
You log in with your e-mail address (a code or a link by e-mail). You are responsible for making sure only the people who should have access do, and for what happens on the account. Tell us quickly if you think someone has gained access without the right to. The person who creates the organisation is its owner and can invite others from the organisation.
5. Subscription and price
The service has two plans: Small, for small organisations, at EUR 49 per month, and Large, for large organisations, at EUR 89 per month. Prices are in euro and exclude value added tax (VAT). VAT and other taxes are added according to the rules of the country you are registered in, and are calculated when you pay. What each plan includes, and the usage limits, are shown where you choose a plan.
We may change the prices with at least 30 days' notice. The new price applies from the next renewal.
6. Free trial month
New customers get 30 days free before the first payment. You must enter a payment card to start. If you do not cancel before the trial ends, the subscription becomes paid and your card is charged for the first month. You can cancel at any time during the trial, and you will not be charged.
7. Payment and renewal
You pay by card through Stripe, every month in advance. The subscription renews automatically each month until you cancel it. We do not receive your card number; Stripe handles it. If a payment fails, Stripe tries again a few times, and we may pause access until payment is in order. You receive a receipt by e-mail.
8. Cancellation and refunds
- You can cancel at any time in the customer portal. The cancellation applies to the end of the period you have paid for, and access lasts until then.
- We do not refund periods that have begun, unless the law requires it or the fault is ours.
- The service is for organisations and businesses, so consumer withdrawal rights do not apply.
- We may close the account with reasonable notice if you materially breach these terms, and without notice in case of abuse or unlawful use. If you do not pay, we may close it after notice.
9. Your content
- You own the content you upload (letters, images, PDFs, organisation details) and what you create with the service. We do not take ownership.
- You give us the right to process the content as far as is needed to provide the service: to read it in, send it to our AI providers, store it and show it to the people in your organisation.
- We do not use your content to train AI models, and our AI providers may not use it for that. See the privacy policy.
- You guarantee that you have the right to upload the content. Preferably upload an unaddressed sample without donors' names and addresses. If the content contains personal data about others, the data processing terms in the privacy policy apply and form part of these terms.
- You can delete each letter at any time. If you ask us to delete the account, we delete the account and all content, normally within 30 days. We keep accounting records for as long as the accounting act requires.
10. Use that is not allowed
You must not use the service for unlawful content or fraud, try to gain access to other people's data, overload the service, extract content automatically on a large scale, or use the service to build a competing service. We have reasonable daily usage limits, for example on the number of new variants and videos.
11. Availability and changes to the service
We do our best to keep the service available, but promise no particular uptime. We may close it for maintenance and change the service. If we remove a function in a material way, you can cancel and get back prepaid time for the rest of the period.
12. Liability
The service is provided as it is. We are not liable for lost gifts, income or reputation resulting from how you use the assessments, nor for indirect or consequential loss. Our total liability is limited to what you have paid us in the last 12 months. The limits do not apply in case of intent or gross negligence, or where the law does not allow them.
13. Changes to these terms
We may change these terms. For material changes we give notice by e-mail or in the service at least 30 days before they apply. If you use the service after that, you accept the new terms. Otherwise you can cancel.
14. Law and disputes
These terms are governed by Norwegian law. We first try to settle disputes amicably. If we do not succeed, they are decided by the Oslo District Court (Oslo tingrett).
